Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights include:- Pay for all salaries earned (INFO # 3) at the rate consented to by the employer and employee.

– Pay of at least base pay (INFO # 1), the relevant Colorado or regional minimum wage, and all earned overtime incomes without impermissible reductions from their salaries;.

– Pay of all made wages without impermissible deductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS imposes a lot of Colorado’s wage and hour and other types of labor employment statutes and labor guidelines, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Spend For Equal Work Act. Please visit the Division’s Labor employment Statutes and Labor Rules websites for current and prior versions of key Colorado labor statutes and guidelines.

Published Guidance: The Division’s main kinds of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s officially authorized notifications, opinions, and descriptions on different labor law topics; and.

– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for employees on their labor rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you incomes, you can send your employer a written demand for payment of incomes by mail, email, text message, or other electronic methods. A written demand may be sent to the company at the same time a Labor Standards Complaint Form for employment unsettled wages is submitted with the Division. The Labor Standards Complaint Form can be discovered on our Demands, Complaints, Responses, and Settlements webpage.

Employer Responses in Investigations: Once a total Labor Standards Complaint Form is gotten and reviewed, a letter explaining the nature of the complaint and the quantities declared to be owed is sent to the company. Investigations Launched by the Division (” Direct Investigations”): The Division may carry out employer-wide direct investigations of potential infractions of Colorado wage and hour law. If you want to submit a tip, please email the Division at cdle_di_tips@state.co.us. If you wish to file an individual claim for unpaid salaries, employment you must fill out a Labor Standards Complaint Form on our Demands, employment Complaints, Responses, and Settlements web page. To appeal a direct investigation citation or one or more Notices of Assessment, an alleged company might submit a Direct Investigation Appeal Form.
